Earlier in 2018, the Government have decided to pay <b><a href="https://apoutsource.blogspot.com/2018/05/ap-outsourcing-employees-maternity-leave-60-days-salary-go-53.html" target="_blank">(60) maternity leave salary</a></b> for the married women for contract and outsourcing employees through <i><b><u><a href="https://drive.google.com/file/d/1w6xxHeBx2ADyhaQgjGdB52YS3nSYRpSU/view?usp=sharing" target="_blank">GO MS No.53</a></u></b></i>. The (60) days paid salary is out of <u><b>(120) days</b></u>.</div>

The Group of Ministers have agreed for sanction of (180) days of <b>paid leave </b>to the women married employees. This condition is relaxed in cases of employees having less than two surviving children.</div>

Extension of the Contractual and Outsourcing Services up to 31.07.2019 in the Government Departments</h2>

Now there is a necessity to continue the Outsourcing personnel in the various departments. </div>

The President, APNGO's Association has given a representation to the Government, stating that the period of 120 days with out remuneration Outsourcing and Contract <a href="https://apoutsource.blogspot.in/2017/10/data-entry-operator-ap-treasury-outsourcing-employees-jobs.html" target="_blank">Women employees</a> are facing many financial problems to lead their daily life. The president has requested the Government to consider 60 days of paid <a href="https://apoutsource.blogspot.in/2018/02/enhancement-salary-ap-outsourcing-employees.html" target="_blank">salary </a>to the Women employees who are in Maternity leave. After careful examination of the representation and taking in view of the Child and Mother care, the Government has taken a decision to pay 60 days of maternity leave to the women employees for two survival children.</div>

Accordingly, the Government have constituted the committee of a <b>Group of Minister's</b> to take necessary action in the matter. After, discussing the above matter the Group of Minister's is agreed to enhance the salary of AP Outsourcing employees who are not covered in the G.O.Ms. No. 151.</div>

On 02.02.2018 Government have issued orders vide <a href="https://drive.google.com/file/d/1v0E7Tbn-JL_W8Ng_ZxrOneDcGBtbJqkd/view?usp=sharing" target="_blank">G.O.Ms. No.7, Finance (HR-1, Plg.-Policy) Department</a> stating that the Group of Ministers constituted to review the existing system of the contractual employment has decided to allow the <b><i><u>enhancement at 50% </u></i></b>of the existing remuneration to the categories of outsourced functionaries who were not covered and remained outside the purview of enhancement of remuneration orders issued in the G.O.Ms.No.151.</div>

Accordingly, the Government hereby issue orders for enhancement of the remuneration at 50% of existing remuneration subject to not exceeding the minimum of the wage in the time scale of the relevant equal category of post in RPS 2015 whichever is less, in respect of outsourcing employees who are nov covered in enhancement orders issued in <a href="http://g.o.ms.no.151/">G.O.Ms.No.151</a>. with immediate effect, subject to following the <b><a href="https://apoutsource.blogspot.in/2017/10/what-are-rules-and-guidelines-for-ap-outsourcing-employees.html" target="_blank">comprehensive guidelines on outsourcing functionaries</a></b> issued in the G.O.Ms.No.151. </div>

The Outsourcing jobs are purely 3rd party jobs. These jobs will not be directly recruited by the AP Government. The outsourcing process acts under the <a href="http://labour.ap.gov.in/" target="_blank">AP Labour Rules & Acts</a>. The AP Government recruits the employees when the departments are required. The government has constituted a committee for selection of <b>outsourcing agency.</b> The following are the committee members for selection of agency. This committee will check all the required rules and acts before the selection of an agency. The agency should renewal contract period with labour department for every year.<br />

In order to understand the Recruitment process first, we need to understand 3 steps of categories.</div>

<b>Principal Employer: </b> A <b>Head of the Department (HOD)</b> is called as a Principal Employer. Because he will request the Government to recruit outsourcing employees. A Principal Employer requests the Finance department for employees recruitment based on the requirement in the departments. Mainly these vacancies will arise when the government regular employees got retired and work demand from a department. The <b><a href="https://apoutsource.blogspot.in/2017/10/data-entry-operator-ap-treasury-outsourcing-employees-jobs.html" target="_blank">Outsourcing Employees recruitment</a></b> will be done in the existing vacancy of regular posts. Filling up of the employees will follow the <b><i>100 point roster method </i></b>in the departments.</div>

After sending the proposal to the Finance Department, it will call and ask the Outsourcing agencies to send qualified employees biodata/resume to them. The finance department scrutinizes the Employees resumes and if required a <b>screening test </b>will be conducted. After careful examination of the employee's list, they will select the qualified employees. The selected employee's list will be communicated to the concerned Outsourcing Agency. The agency sends the selected employee to the Department. The department will engage the employees on outsourcing basis duly following the 100 roster method and making a fresh <b><u>agreement </u></b>with the agency. This agreement will renew every year based on the requirement of the employees in the departments. </div>

<b>Employer (Outsourcing Agency): </b>An employer is called as Outsourcing Agency which is gives outsourcing jobs to the unemployed personnel. Head of the Department is called to be "<b>Principal Employer</b>". A principal employer has to take permission from the Finance Department for recruitment of Outsourcing employees in their departments. The required department will send the proposal to the Finance department for want of Outsourcing Employees. After the sanction approval of the posts, the selected agencies will approach the department. The outsourcing agency will send the qualified persons in the ration 1: 5 to the selection committee with the original certificates. The committee verifies the certificates and if needed a test will be conducted in the concerned subject. Then, shortlisted candidates will be recommended to the outsourcing agency. The agency recruits the selected candidates by making an agreement with the department. </div>

What is the Remuneration / Salary for the AP Outsourcing employees?</h3>

The <b>Finance department</b> will take the decision to fix remuneration/salary to the employees. The remuneration will be fixed for the current PRC. The Outsourcing agency has the responsibility for paying the salaries of the employees from time to time. This process will be monitored by the Principal Employer (Head of the Department). If the funds are not available with the department, it has to write an additional budget proposal to the Finance Department. Then the Finance department will <span style="background-color: white;">give administrative sanction </span>for additional budget to the department. When comes to the one month bill meaning is from <b><u>21st of every month to 20th of next month</u></b>. The government has released orders to the AP Treasury Department to admit the bill of Outsourcing employee of 20th of every month and the salary will be released on the <a href="https://apoutsource.blogspot.in/2016/10/ap-outsourcing-employees-salary-on-every-1st-day-of-month.html" target="_blank"><b>1st day of every month</b>.</a></div>

What is the process to monitor the ap outsourcing employees remuneration/salaries by the Principal Employer?</h3>

Every month agency will submit the <b><a href="https://apoutsource.blogspot.in/2016/08/ap-outsourcing-employees-enhanced-salary-GO-151.html" target="_blank">salary/remuneration</a> </b>bill to the Department for claiming the salary of the employees. In this process, the agency would have to pay <b>EPF, ESI</b> of the outsourcing employee share along with the agency share of EPF, ESI and Professional Tax. The receipt of the EPF and ESI should enclose to the salary bill. Then Principal Employer has come to know whether the agency is paying the EPF and ESI regularly or not.<br />

The concerned department gives the proceedings order for claiming the bill. The department will submit the remuneration bill in the <b>PAO</b> (If the employee working in the HOD) or any subordinate office of Treasury <b>STO/DTO</b> (If the employee working in the subordinate offices). The treasury department will process the bill for payment and the salary will deposit in the account of the agency. The agency will pay the remuneration/salary from their account to the AP outsourcing employee bank account. The salary should pay in the shape of <b>Cheque </b>only.</div>

Here are two types of deducts and credits will be done. First one is Employee share and the second one is Government share. The agency deducts 12% of EPF as employee share in the salary of the employee and 13.61% of EPF will add by the agency share (That means Government share). <li>The NGO State & JAC President <u>Mr Ashok Babu</u> has demanded the AP Government for <b>regularization </b>of Outsourcing Employees working in the Andhra Pradesh Government Departments.</li>
<li>The President of NGO has spoken in the meeting stating that a Committee has constituted by a group of Ministers for permanent more than 20,000 outsourcing and contract employees working in various departments in AP.</li>
<li>But the committee had not given any report to the AP Government.</li>

<li><b><u>The Commission has established in the United AP. After bifurcation</u></b>, the RTI Commission has not been established in Andhra Pradesh.</li>
<li>Both the states of "<i><b>Outsourcing and Contract Employees"</b></i> are working in the Commission in the state of Telangana. </li>
<li>Some of the Outsourcing and Contract Employees working in the RTI Commission have approached to the High Court for "<u><i><a href="http://apoutsource.blogspot.in/2016/10/ap-outsourcing-employees-salary-on-every-1st-day-of-month.html">Continuation and Payment of Salaries</a></i></u>". </li>
<li>The petition has taken by the High Court and proceeded for the arguments on 11th August 2017.</li>
</ol>

The Hon'ble High Court has ordered the TS Government for Continuing and Pay the salaries to employees.</blockquote>

<li>As per the bifurcation ratio, the Court has ordered to <a href="http://apoutsource.blogspot.in/2016/12/continuation-go-220-for-outsourcing-contract-employees.html">pay the salaries </a>in the ration 58:42.</li>
<li>The Hon'ble High Court has stated that by the reason of not bifurcating the Commission, It is not correct to throw employees out.</li>
<li>The Govt. Pleader of Telangana State has stated that <b><i><u>all the Commissioners will be recruited with in 6 weeks</u></i></b> and also be continuing the employees duly paying the salaries in the ratio 58:42.</li>
<li>In the meanwhile, the AP Govt. Pleader has argued that <u><i><b>this is not possible because the Commission has not been bifurcated yet.</b></i></u></li>

<b>ORDER</b>:</div>

<li style="text-align: justify;">In the reference first read above, Government has issued instructions and laid down the procedure regarding payment of remuneration to all the contact / outsourced personnel as well as aided instructions on the 1st day of every month promptly. in the Government order second read above, comprehensive guidelines were issued regarding the selection of outsourced personnel.Payment of remuneration, continuation fo services and grievances if any, in government departments. <b><i><u>In the GO third read above, orders were issued enhancing the rates of remuneration payable to the outsourced employees from 1st August 2016 with detailed instructions for payment of remuneration.</u></i></b></li>

<li style="text-align: justify;">In spite of the above instructions, some instances have come to the notice of the Government of irregular or delayed payment of remuneration to the contract / outsourced personnel on account of delay in submission of the claim on the part of the agency or due to procedural constraints such as insufficient budget or delay in preferring claims by Drawing and Disbursing officers.</li>
<li style="text-align: justify;"><b>In order to ensure payment of remuneration on the first working day of every month contract and outsourced personnel Government hereby issue the following instructions for strict compliance by all this party agencies supplying the manpower, Drawing and disbursing officers and Treasury authorities concerned.</b></li>
</ol>

<h4 style="text-align: justify;">
Four instructions have been issued:</h4>

<h3>
<ul style="text-align: left;">
<li><b>Action 1</b>: <i><u>20th of each month</u></i></li>
</ul>
</h3>
<ul>
<li>Outsourced personnel: the bills relating to outsourcing personnel shall be submitted to the DDO concerned with all relevant documents, vouchers and schedules.</li>
<li>Authority concerned: The third party agency which supplies outsourced personnel. Establishment section in the case of contract employees.</li>
<li><b><u>Contract persons:</u></b></li>
<li>The supervising officers concerned shall furnish the Attendance, absence, leave particulars and the work turn out certificates, whether require shall be furnished to the DDOs.</li>
</ul>

<ul style="text-align: left;">
<li><b>Action 2:</b> <i><u>25th of each month</u></i></li>
</ul>
</h3>
<ul>
<li>Outsourced personnel and contract personnel: Bills should be prepared and submitted to the Treasury Authorities / FAO concerned. The Drawing and Disbursing officers shall take the action.</li>
</ul>
<h3>
<ul style="text-align: left;">
<li><b>Action 3:</b> <i><u>28th of each month</u></i></li>
</ul>
</h3>
<ul>
<li>Outsourced personnel: The bills shall be scrutinised encased. Necessary cheque payable on the first working day of the next month, be prepared and delivered to Third party Agency through DDO Concerned. The Treasury authorities/ PAO concerned.</li>
<li><u>Contract personnel: </u>The bills shall be scrutinised and passed and the remuneration has to be credited to the bank account of the DDOs concerned. The Treasury authorities/ PAO concerned.</li>
</ul>
<h3>
<ul style="text-align: left;">
<li><b>Action 4:</b> <u><i>First Day/ First working day of every month</i></u></li>
</ul>
</h3>
<ul>
<li>The remuneration is paid to the bank accounts of the outsourced personnel contract employees. The third party agencies. </li>
<li>The DDOs shall take necessary action to credit the remuneration to the bank accounts of the contract personnel. The DDOS concerned.</li>
</ul>

<div style="text-align: justify;">
The above schedule shall be scrupulously followed by al the concerned authorities and any deviation will be viewed seriously and the officers concerned will be held responsible.</div>
<div style="text-align: justify;">

<ol>
<li style="text-align: justify;">In order to prevent rejection of bills which are otherwise eligible but could not be passed for want of sufficient budget provision under 300 other contractual services, the Government hereby relax te Treasury control on the detailed head of account <b>"300 Other Contractual Services"</b> for the financial year 2016-17 under all the Major Heads o Account. The Controlling Officers shall submit6 necessary proposals for the provision of necessary funds either by way of reappropriation of savings within the grant or provision of additional funds through supplementary grants at the appropriate time without fail.</li>
<li style="text-align: justify;">All other conditions relating to the admissibility of the claim shall be adhered to and the Treasury officers /PAO shall ensure proper scrutiny of the claims.</li>
</ol>
<blockquote class="tr_bq">
<ol>
<li style="text-align: justify;">The agencies shall disburse remuneration to the outsourced personnel by the first day of every month as instructed at Para 3 (a) above, In the case of the default, <b><u>1% of total claim</u></b> be levied as a penalty for delay in payment beyond three working days. The penalty shall be recovered from the claim relating to the succeeding month.</li>
</ol>

<ol>
<li style="text-align: justify;"><b>In the case of recurrence of delayed payments on more than three occasions, the agency shall be blacklisted.</b> It is the responsibility of the officer who entered into the agreement with the agency, to ensure prompt disbursements by the agency to the outsourced personnel and to impose penalty otherwise.</li>
<li style="text-align: justify;"><b>The agencies shall not pass on penalty so imposed on to the outsourced personnel or deduct any amount from the remuneration other than the statutory obligations.</b></li>
<li style="text-align: justify;">The existing contracts shall be revised only incorporation the above penal provision in the contract and a new contract shall be executed for the remaining period of the contract. The controlling authorities shall the prompt action in this regard.</li>
<li style="text-align: justify;"><b><u>All the departments of Secretariat. Head of Department s shall follow the above instructions scrupulously. They shall communicate this order to all the subordinate officers under their control for strict compliance.</u></b></li>

AP State Government has released the enhanced salary <a href="https://drive.google.com/open?id=0ByUh702aqzhQd2dteWtwMUpnZTA">G.O. MS. No. 151 (HR-I-Plg. & Policy) Department, dated on 8th August 2016</a>. The benefits will get the outsourcing employees from 1st August 2016. Many of the employees more than 1,00,000 have been benefited. The method of salary enhancement was divided into three categories.<br />

<li>The employee who draws the salary between Rs. 10,900 to Rs. 13,660 are hiked to Rs. 17,500. </li>
<li>In the second category, salary draws between Rs. 7960 to Rs. 10020 are hiked to Rs. 15,000. </li>
<li>In the third category, salary draws between Rs. 6700 to Rs. 7960 are hiked to Rs. 12,000.</li>
